Official Rules

Summary of Contest: Official HNHN Partner and Premier Partner organizations have a chance to win $5,000 to spend on a healthy activity for staff/employees.

The American Nurses Association (“ANA”) challenges Partner or Premier Partner organizations to encourage as many staff/employees from your organization as possible to join the Healthy Nurse, Healthy Nation™ (HNHN) Grand Challenge. The Partner or Premier Partner organization with the most staff/employees to join the HNHN Grand Challenge during the contest period will be the lucky winner!

Why is this important? The health of nurses and the nation matter to us and to you! A great way to show your dedication and commitment to Healthy Nurse, Healthy Nation is to show your strength in numbers. By getting more of your staff/employees to join the Healthy Nurse, Healthy Nation Grand Challenge you will motivate more of your staff/employees to lead healthier lives and in turn they can inspire others, including patients to be healthy too!

Whether it’s providing a nutritious meal, offering on-site massage therapy, or developing a health and wellness program, you can use this prize to help support your mission to improve the health of your staff/employees.

This contest (“Contest”) is sponsored by ANA.

Contest period: The Contest begins at 9am, EDT on October 9, 2017. Entries must be received by midnight, November 20, 2017.

Eligibility: The Contest is open to all organizations registered as a Partner or Premier HNHN Partner. The partner must be incorporated or organized under the laws of the United States, the District of Columbia, Puerto Rico or other U.S. territories, and located therein.

ANA subsidiaries and HNHN Friends are not eligible to participate.

To enter: Your staff/employees must go to www.healthynursehealthynation.org and create a HNHN profileusing the “Individuals” button. When creating a HNHN profile, staff/employees must select the name of your organization in which to be affiliated.

The date and time of the registration submission on the site constitutes the official time of your organization’s entry for purposes of the Contest.

Only individual submissions are allowed. ANA will not be responsible for lost, incomplete, misdirected, illegible, late, malfunctioning entries, or for failed computer transmissions or technical failures.

By entering the Contest, each participant organization fully and unconditionally agrees to and accepts these Official Rules and any decisions made by ANA, which shall be final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein. No exceptions or substitutes will be made.

Judging: The top five organizations with the highest numbers of staff/employee registrations during the contest period will be entered as finalists. From the list of five finalists, one organization will be randomly selected by a reviewing committee appointed by ANA.

The decisions of the contest judges will be final and binding. ANA reserve the right to disqualify any entry at any time which, in ANA’s opinion, endangers the safety or well-being of any person, or fails to comply with these Official Rules.

The Winner will be announced by ANA electronically on November 27, 2017.

Prize: Five Thousand Dollars ($5,000) in cash to be destined to support the winner organization’s mission to improve the health of its staff/employees.

Odds of winning will depend on the number of entries. Upon entry into the contest, the winner organization, as well as all other entrants, is required to comply with any and all applicable federal, state and local laws, rules and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Official Rules are solely the winner’s responsibility. Prizes are not assignable.

General Conditions/Release: By entering the Contest, participant organizations (a) release ANA, its affiliates, partners, representatives, agents, successors, assigns, employees, officers, directors, and volunteers (“ANA Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of a prize; and (b) acknowledge that the ANA Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the prizes including, but not limited to, their quality or availability, or suitability. The ANA Parties will not be responsible for typographical, printing, or other inadvertent errors in these Official Rules or other materials or announcements relating to the Contest, or for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any on-line service or Website, or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in this contest. ANA reserve the right to disqualify anyone found to be tampering with or otherwise abusing any aspect of the contest as determined by them in their sole discretion. ANA also reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest if tampering, viruses, bugs or other causes beyond its reasonable control corrupt the administration, security, fairness or proper operation of the Contest. Should the Contest be terminated prior to the stated end date, ANA reserves the right to choose winners from among the submissions entered prior to the early termination date.

All federal, state, and local laws and regulations apply. Void where prohibited.

Disputes: By entering the Contest participant organizations agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Maryland; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (c) under no circumstances will participant organizations be permitted to obtain for, and each participant organization hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, participant organizations’ rights and obligations, or the rights and obligations of ANA in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Maryland, without giving effect to any choice of law or conflict of law rules (whether of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Maryland.
